SCOPE OF APPLICATION OF THE GENERAL TERMS AND CONDITIONS

Lara Lanawi shall provide all services and deliveries on the basis of these General Terms and Conditions. The GTC apply to all orders placed through Lara Lanawi’s website.

The General Terms and Conditions apply to all contracts of purchase, supplies and other services between Lara Lanawi (hereinafter referred to as « seller » or « provider ») and the consumer or trader (hereinafter referred to as „you“ or „customer“).

This website is operated by Lara Lanawi. Lara Lanawi offers this website, including all information, tools and Services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.

ONLINE STORE TERMS

The provider reserves the right to refuse Service to anyone for any reason at any time.

All artwork, images and contents of the website are a sole property of Lara Lanawi and cannot be copied or used without written permission from Lara Lanawi.

You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service or any contact on the website through which the Service is provided, without express written permission of the seller.

OFFER AND CONCLUSION OF CONTRACT 

The customer can select products from the range of the provider and collect them in a so-called shopping cart by clicking the “Add to cart” button. By clicking on the “Place order” button, he submits a binding request to purchase the goods in the shopping cart. However, the application can only be submitted and transmitted if the customer has accepted these contractual terms and conditions. By clicking on the button “I agree that I have read and agreed to the General Terms & Conditions, Shipping & Return Policy and Privacy Policy.”, the customer submits a legally binding offer of contract with regards to the product in the virtual basket.

The provider then sends the customer an automatic order confirmation by e-mail, in which the customer’s order is listed again and which the customer can print out using the “Print” function.

CURRENCY & PAYMENT

Prices on the website are stated in Swiss francs (CHF).

All payment can be made using one of the payment options mentioned in the online shop of the seller. These may be updated, please check options at checkout.

Payments with credit cards or debit cards are made via STRIPE. When paying with cards, the provider naturally wants to offer the highest level of security and therefore processes via the payment service providers STRIPE. You do not need a STRIPE account for this. You have the opportunity to use this service for secure payment with your credit card as a guest access, without registration, without obligation and of course free of charge.

In case of non-availability of the goods the seller shall inform the customer without delay and payments made by the customer will be immediately refunded.

RETENTION OF TITLE

The shipping goods remain the property of the provider until full payment has been received.

The Seller shall be entitled to withhold delivery of any goods if at the time of delivery is to be made, payment is due by the customer to the seller on any account whatsoever.

MODIFICATIONS TO THE SERVICE AND PRICES

Prices of the products are subject to change without notice. The seller reserves the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time.

The seller shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the Service.

ACCURACY COMPLETENESS & TIMELINESS OF INFORMATION

The provider is not responsible if information made available on this site is not accurate, complete or current. These restrictions may include orders placed by or under the same customer name, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that the provider makes a change to or cancel an order, he may attempt to notify you by contacting the e‑mail and/or billing address/phone number provided at the time the order was made. The seller reserves the right to limit or prohibit orders that, in his sole judgment, appear to be placed by dealers, resellers or distributors.

The provider shall not be liable for any damages resulting from the use of the artwork purchased. In particular for improper use or installation. Claims for damages against the seller due to consequential damage from the use of the paintings are excluded.

COLORS

The seller has made every effort to display as accurately as possible the colors and images of the products that appear on the website. The seller can not guarantee that your computer monitor's display of any color will be accurate.

Discrepancies in color of the product, shown on the website and color of the original product are possible due to technical conditions, like the different color settings of computers and monitors.

GOVERNING LAW 

All contracts and agreements between the customer and the provider will be governed by the Swiss Law, to the exclusion of the United Nations Convention on Contracts for the International Sale of Goods.

The Swiss courts shall have jurisdiction over any disputes arising directly or indirectly in relation to this Agreement, be it a dispute in tort or in contract or for any other cause. Place of execution is Geneva (Switzerland).

If the customer is a merchant, a legal entity under public law or a special fund under public law, the place of jurisdiction for all disputes arising from contractual relationships between the customer and the provider is the location of the provider.
